STATUS TERDAKWA SETELAH SURAT DAKWAAN DINYATAKAN BATAL DEMI HUKUM DALAM PERKARA PIDANA

Abstract

ABSTRACT 

In line with the objective of intending to explore legal principles and legal systematics, and seeking clarity on the status of the accused after the indictment was declared null and void by law in the Indonesian legal system, the type of research was classified as normative legal research which did not intend to test the hypothesis.The method of data collection is carried out by means of library research, which records the literature / references related to this research, in order to obtain secondary data by examining primary legal materials consisting of statutory regulations and secondary legal materials in the form of text books, scientific journals as well as documents relating to this study that have transitions for reference in research on the defendant's problem after the indictment has been declared null and void by law is fixed in its legal position, then the Public Prosecutor refines the indictment and is sent back to the Court for trial.
