PENERAPAN ASAS PERSAMAAN HAK DIDEPAN HUKUM TERHADAP ANGGOTA POLISI YANG MELAKUKAN TINDAK PIDANA PADA TAHAP PENYIDIKAN DI WILAYAH HUKUM POLDA SUMSEL

Abstract

Indonesian National Police (Polri) has a responsibility to preserve and protect the public. But in reality, the police sometimes act outside the procedure or against the law. The research method used in this research is empirical normative , the issues that raised in this research are: how is the application of the equality before the law for the Police who did the criminal act on the Investigation stage in the Regional Police jurisdiction of South Sumatra? And is there any policy, for the police who did the criminal acts in the Regional Police jurisdiction of South Sumatra?.The results of this research indicate that police are still doing a violence or put pressure on civilians during the investigation process, it's different with the investigation process to the police who did a criminal act, no violence or pressure, the application of the equality before the law during the investigation process both for the police and ordinary civilians who did criminal acts is still discrimination and there is no special policy within the police.Police who did criminal act can be dismissed with no respect (PTDH) or not fired, derived from the evaluation of the Legal superior or higher legal superior. So that it cannot be said to be a policy, because it has become its authority and indeed has been regulated in the Police Chief Regulation No.14 of 2011 regarding about The Professional Ethics Code.
