EFEKTIVITAS PENERAPAN PASAL 29 AYAT (1) HURUF t TENTANG MEMBERLAKUKAN SELURUH LINGKUNGAN RUMAH SAKIT SEBAGAI KAWASAN TANPA ROKOK MENURUT UNDANG-UNDANG REPUBLIK INDONESIA NOMOR 44 TAHUN 2009 TENTANG RUMAH SAKIT (STUDI KASUS DI RUMAH SAKIT UMUM DAERAH KABUPATEN OGAN ILIR)

Abstract

In view of the dangers contained in a cigarette and in to create a clean and healthy hospital environment and free from tobacco smoke, the government in the Law of Republic of Indonesia Number 44 of 2009 on Hospital, as stated in Article 29 paragraph (1) letter t, that each hospital has the obligation to enforce the entire hospital environment as a non-smoking are. To understand the problem in detail so as not to be too widespread, the authors formulate it into two formulation of the problem, namely 1. Whether the application of Article 29 paragraph (1) letter t on imposing the entire hospital environment as a non-smoking are according to Law of Republic of Indonesia Number 44 of 2009 on hospital (case study at the Rumah Sakit Umum Daerah Kabupaten Ogan Ilir) has been effective ?, and 2. What factors influence the effectiveness of the application of article 29 paragraph (1) letter t is ? In order to obtain maximum research result , hence there are some method that writer useas approach tool especially in searching data in field, that is in the form of interview with some hospital employees, such as director of RSUD Kabupaten Ogan Ilir, Head of administration department of RSUD Kabupaten Ogan Ilir, Head of sub-division of staff of RSUD Kabupaten Ogan Ilir. The data collected, finally analyzed with the approach of Theory of Law Efeectiveness and Law Enforcement Theory, which the authors describe qualitatively. From the reseach result, the application of article 29 paragraph (1) letter t on imposing the entire hospital environment as a non-smoking area according to the Law of Republic of Indonesia Number 44 year 2009 on hospital (case study at the Rumah Sakit Umum Daerah Kabupaten Ogan Ilir) has not been effective and the factors that influence the most dominant are the law enforcement factors in this case the management of RSUD Kabupaten Ogan Ilir, which should follow up the regulation with the internal regulation of hospitals formulated in conjunction with the hospital staff, so that the implementation of the area without smoking can run effective.
