Jurnal Kepastian Hukum dan Keadilan is a journal or media information and communication in the field of law contains scientific articles of research related to the field of legal science that includes civil law, criminal law, constitutional law, state administrative law, economic / business law, constitutional law, Islamic law, environmental law, customary law, international law, and others related to legal issues.

Peer Review Process

Jurnal Kepastian Hukum dan Keadilan was published in print as Open Journal System (OJS) since 2019 under the management of the Faculty of Law, Muhammadiyah University of  Palembang.

The frequency of publication of the Jurnal Kepastian Hukum dan Keadilan is two times a year, periodically in June and December.  All articles are published through peer review process conducted by the board of editors and reviewers, both internal and external.

Peer-Review Process begins with a review related to the accuracy of the fulfillment of author guidelines or article writing guidelines and review journal templates by the Board of Editors or editorial board both internally and externally. The editor is in charge of carefully checking and ensuring that the article being reviewed meets the Author Guidelines and Journal Templates. Furthermore, the editor is in charge of providing the results of the assessment by filling out the assessment result form or assessment form. The next process, the editorial team returns the article according to the results of the review from the Board of Editors if the article still does not meet the Author Guideline or Journal Template to be revised by the author.

In the review process by the Editorial Team, a review is also conducted related to checking similarity and/or plagiarism using Turnitin and/or other plagiarism tools. Articles that have met the requirements of the review process from the editorial team, are followed by the review process by reviewers. The editor is in charge of sending articles electronically to reviewers, both internal and external.

Internal reviewers and external reviewers who conduct the peer review process are tasked with reviewing and assessing the substance of the article, assisting the author by providing comments and inputs both related to the state of arts and other components of relevant substance.  The implementation of the review process uses double blind review. The ethical review process is carried out for the substance of the article, criticism and input is carried out objectively. Reviewers present clear views and inputs supported by clear arguments. Criticism of the author's personality is an unethical and inappropriate action carried out by reviewers during the review process in this journal.

In detail, the reviewers is tasked with identifying relevant legal documents, concepts, theories and previous studies that are used by the author to review and analyze. The reviewer is also tasked with identifying relevant reading sources or study results that have not been cited by the author.

The entire review process is conducted electronically. After the peer review process stage of reviewers is completed, then the Journal Editor decides which articles are worthy of publication, taking into account the results of the initial review of the editorial team, the validity of the article from the results of reviewers, the benefit and contribution of the substance of the article in the development of legal science for researchers, academics, and practitioners, especially related to the development of legal substance locally, nationally, and internationally. The final stage of the peer review process is accepted and copy editing and publication.

This journal provides immediate open access to its content on the principle that making research freely available to the public supports a greater global exchange of knowledge.

 

Publication Ethic

Jurnal Kepastian Hukum dan Keadilan has been published in print as an Open Journal System (OJS) under the management of the Law Study Program, Faculty of Law, Muhammadiyah University of Palembang.

The management of the Jurnal Kepastian Hukum dan Keadilan is managed in accordance with the publication ethic journal, which is related to Open Access Policy, Frequency Publications, Board of Editor Policy Ethic, Board of Editor Policy Ethic, Reviewer Policy Ethic, Authors Policy Ethic. Referring to the publication ethic that has been established, this journal is published based on OJS. Articles are published through the review process of the Board of Editors, the review process of the reviewer team both internal and external. Articles published in accordance with focus & scope of the journal written by the author based on the Author Guidelines and Template Journal.

Open Access Policy Ethic

Jurnal Kepastian Hukum dan Keadilan is a print journal based on Open Access Journal, therefore ethically this journal article can be accessed openly by readers. It is intended to support the development of the spread of sciences, especially related to the results of law studies, both in the local, national and international.

Publication Decisions

The Editor of the Jurnal Kepastian Hukum dan Keadilan is responsible for deciding which articles are submitted to the journal that should be published. Validation of questionable work and its importance to researchers and readers should always drive those decisions. Editors can be guided by the journal's editorial board policies and limited by the legal requirements that will apply to defamation, copyright infringement, and plagiarism. Editors can work closely with other editors or reviewers in making these decisions.

Fair Play

Editors at all times evaluate manuscripts for their intellectual content regardless of the author's race, gender, sexual orientation, religious beliefs, ethnic origins, nationalities, or political philosophies.

Confidentiality

Any editors and editorial staff may not disclose any information about the manuscript submitted to anyone other than the authors concerned, reviewers, prospective reviewers, other editorial advisors, and publishers, as appropriate.

Disclosure and conflicts of interest

Unpublished material disclosed in submitted manuscripts should not be used in the editor's own research without the author's written consent.

The following statement describes the ethical conduct of all parties involved in the act of publishing articles for the Journal of Justice and Legal Assurance, namely: authors, editors, and peer reviewers

Duties of the Editorial Board

Publication of articles in this Journal through the Peer-Review Process which begins with a review of journal templates by the Board of Editors or editorial board as follows::

The Board of Editors both internal and external is tasked with carefully examining and ensuring that the article being reviewed must meet the Author Guidelines and Journal Templates.

This process is carried out in a single blind reviewer gradually towards double blind reviewer.

The editor is tasked with providing the results of the review or assessment results by filling out the assessment results form / assessment format.

Managing Editor is tasked with returning articles according to the results of the review from editors while the article still does not meet author guidelines and journal templates and publication ethics for authors.

In the process of review by editorial team, also conducted examination related to similarity checking using Turnitin and/or other plagiarism tools.

The entire process of reviewing articles by the Board of Editors is conducted electronically, and the editor is ethically responsible for maintaining the confidentiality of the entire review process, except for the benefit of the author and the journal publication process in this journal.  Unpublished articles should not be used in research and publication editors without the author's written consent.

Duties of Reviewers

In this journal, all articles published through the peer review process conducted by internal reviewers and external reviewers who have scientific competence in accordance with published articles. The reviewer is tasked with assessing the substance of the article, assisting the author through comments and inputs both related to the state of arts and other relevant substance components. The review process is carried out using double blind review.  The review process is ethically carried out for the substance of the article, criticism and input is carried out objectively. The reviewer provides clear assessments, views and inputs supported by clear arguments. Criticism of the author's personal is an unethical and inappropriate action carried out by reviewers during the review process in this journal.

The reviewer is tasked with in detail assessing and identifying the relevance of legal documents, concepts, theories and results of previous relevant studies used by the author to review and analyze. The reviewer is also tasked with identifying reading sources or relevant study results that have not been summarized by the author. Every article reviewed by the reviewer is confidential which must be kept confidential, ethically correspondence related to the article to the author must go through the journal manager. The review process should not be carried out by the reviewer in the event that there is a conflict of interest with the author. Reviewers should not use the article being reviewed for their own benefit.

Duties of Authors

The author who wish to publish their articles in this journal must follow the requirements as presented in the Author Guidelines and Journal Templates. Articles sourced from research results must present their research methods clearly and accurately in accordance with the prevalence of research methods in the field of legal science. The data presented in the form of tables, matrix or images must include the source. Dishonesty in submitting data and references is unethical conduct that is not tolerated in this journal.

With regard to originality, it is conducted by the Turnitin process and/or other tools, and if the author uses the results of previous studies to support their article, it must be ensured that ethically the use of the cited work has been mentioned through the appropriate footnote mechanism. The author should not submit the same article in multiple journals, and the same article that has been published elsewhere should not be submitted in this journal, as such acts constitute unethical conduct.

The names listed in the article as the author are all the people who contributed to the writing of the article. The inclusion of the name of the author who does not contribute to the realization of the article to be published is unethical conduct.

 

Plagiarism Policy

Jurnal Kepastian Hukum dan Keadilan editorial board recognises that plagiarism is not acceptable and therefore establishes the following policy stating specific actions (penalties) upon identification of plagiarism/similarities in articles submitted for publication in Jurnal Kepastian Hukum dan Keadilan. Jurnal Kepastian Hukum dan Keadilan will use Turnitin's originality checking software as the tool in detecting similarities of texts in article manuscripts and the final version of articles ready for publication. A maximum of 20% of similarities is allowed for the submitted papers. Should we find more than 20% of the similarity index, the article will be returned to the author for correction and resubmission.

Level of Plagiarism

Minor: A short section of another article is plagiarised without any significant data or idea taken from the other paper
Action: A warning is given to the authors and a request to change the text and properly cite the original article is made

Intermediate: A significant portion of a paper is plagiarised without proper citation to the original paper
Action: The submitted article is rejected and the authors are forbidden to submit further articles for one year

Severe: A significant portion of a paper is plagiarised that involves reproducing original results or ideas presented in another publication
Action: The paper is rejected and the authors are forbidden to submit further articles for five years.

It is understood that all authors are responsible for the content of their submitted paper as they all read and understand khk's Copyright and Licensing Terms. If a penalty is imposed for plagiarism, all authors will be subject to the same penalty.
